*
Check that you have an economic operator in the EU to represent you.
Register your brand name with the European Commission.
Check that the model name hasn’t been taken by another economic operator.
2. You want to appoint an authorised representative to represent you in the EU. How do you do that?

You issue a written mandate to the representative.
You include a Declaration of Appointment of the representative in the technical documentation for the product.
You register the representative in the European Commission’s Safety Gate platform.
3. Does the mandate have to be written?
*
No. An oral agreement has the same validity as a written agreement.
It depends upon the EU Member State where the economic operator has his business address.
Yes. The EU legislation requires that such a mandate is always written.
4. What role will a responsible economic operator undertake in the EU?
*
He will channel all payments from the EU to you.
He will represent you in product compliance and safety matters and undertake other tasks identified in the European market surveillance regulation 2019/1020.
He will register your company in the Chambers of Commerce in the EU Member States where you will sell your product.
5. How will authorities or customers know who is the economic operator?
*
Anybody can look him up on the European Commission’s Safety Gate.
His name, address and contact details must be printed on the product or on the packaging.
The information must be found on your website.
6. You are exporting personal protective equipment to the EU market and you want an economic operator to represent you. You can choose between your importer, the fulfilment service provider, and a lawyer who has offered to act as an authorised representative. Which of these can you appoint legally?
*
The European legislation allows you to use any of the three.
Only businesses with whom you trade your products.
Only those who are represented in the whole European Union.
7. What is a fulfilment service provider?
*
A provider of services in the product safety area, e.g. type testing, CE-marking, storing technical documentation, etc.
A business that handles products by offering services like warehousing, packaging, addressing and dispatching the products without owning them.
A lawyer that ensures that your contracts with your customers are fulfilled.
8. What safety requirements apply to products sold from an online platform outside the EU?
*
The safety requirements are stricter because the customer cannot easily complain to the manufacturer.
None, because the products are sold from outside the EU.
The same safety requirements always apply no matter the trade channel.
